A Court of Appeal in the Abuja Judicial Division Holden at Abuja has adjourned for hearing a suit seeking to sack the Elelo of Idofin, Isanlu, Yagba East LGA of Kogi State, Oba Shadrach Durojaiye Abraham Obigbemi, a third class Chief in Kogi State.
The Chieftaincy tussle between Mr. Michael Abolarin Clement, the Appellant and Mr. Shadrach Durojaiye Abraham Obigbemi and nine others joined as respondents, has been fixed for hearing on the 11th March, 2021.
The Appeal No: CA/A/1001/2018 and suit No: KGS/IHC/02/2017 which came up at the Abuja Judicial Division yesterday is seeking to sack Mr. Shadrach Durojaiye Abraham Obigbemi as the Elelo of Idofin, with the appellant claiming that he was not validly nominated to the stool.
Others joined in the suit are the Kogi State Governor, the Attorney General and Commissioner for Justice; Commissioner for Local Government and Chieftaincy Affairs, Kogi State Council of Chiefs, Yagba East Traditional Council and the Okun Tradional Council.
The appeal was called up for the hearing of Motion on Notice dated and filed 11th June, 2019 to regularise the Records and Supplementary Record of Appeal as properly compiled and transmitted.
The Court granted the Application and also deemed the Appellant’s Brief of Argument filed on the same date as properly filed and served today.
The Attorney-General of Kogi State and four other counsel appeared for all the Respondents while Emmanuel Oluwabiyi Esq and two other lawyers appeared for the Appellant.
Recalled that the suit at the Kogi State High Court was earlier dismissed as the trial judge said the complainant could not prove his case beyond reasonable doubt.
But dissatisfied with the Ruling of the lower Court, the appellant challenged the judgment, which he described as a miscarriage of justice, vowed to get justice at the appeallate court.
