The Niger State High Court (Vacation Court) presided over by Hon. Justice Bilkisu Yusuf Gambo has delivered a Judgment in a matter between the Council Chairman of Mariga Local Government,Hon. Idris K. Ibrahim Versus. Mariga Local Government Legislative Council and four (4 ) other’s all in favour of the Chairmen (Plaintiff )this morning, 18th August, 2022.
The matter was instituted by the Council Chairman of Mariga Local Government following his purported suspension and removal from office by the Local Government Legislative Council vide a letter served on him to that effect in January, 2022.
The judge in her judgment lambasted the Local Government Legislative Council for their fragrant and total disregard and disrespect for the rule of law and requisite dictates and provisions of the law.
According to the Presiding Judge,Hon.Justice Balkisu Gambo Yusuf in the judgement said that the wordings and intent of the provisions of both the Constitution of the Federal Republic of Nigeria 1999 (as amended) and that the Local Government Law 2001 and the amendments thereto are simple, clear and unambiguous and have accordingly provided for the procedure for suspension and removal of a Council Chairman and same was completely disregarded by the Mariga Local Government Legislative Council.
On the whole, the Court held that the purported suspension and removal of the council chairman vide the letter dated in January, 2022 is illegal, null and void
That the (Plaintiff) Hon Idris K lbrahim should resume office and to be allowed to discharge his official duties immediately.
The Court also held that all his salaries and entitlements from the purported suspension/removal to date should be paid to him, amongst others.
