Out going President of ECOWAS Court violates staff human right.


 

The last administration President of ECOWAS Court of justice who have served two tenure absolute as the President of the Court according to the extant law and not renewable have allegedly violated the employment right of an Executive Assistant to the Nigerian Judge through planned constructive dismissal.

 

The Executive Assistant who have instituted a legal action before the court, in which the President of the Commission is joined as Respondent, seeks for interim injunction to stop the violation of his right pending the determination of the suit by asking for status quo to be maintained.

It will be recalled that the tenure of judges which is four years absolute was extended to allow three judges take care of the positions allocated to the junta ruled countries.

However it was gathered that the President who has completed his tenure allegedly interpreted the renewal as a reappointment to allow room for the retained judges to drop their EA contrary to the spirit of the decision of the Council extending their tenure.

Threatened with violation of right to work, the Nigerian EA has approached the court to enforce his human right to work and gainful employment.

It’s yet to be seen whether the Judges will obey their own court by granting injunction to stay action until the determination of the suit.

Whatever they do will to a large extent be under scrutiny of the ECOWAS region, if they flout their own court, it will determine how seriously the community will take the enforcement of their judgement in the future.

The public is watching to see what will unfold from the suit which also seek for accelerated hearing.
