A Benin High Court 3 sitting in Benin City, has adjourned the criminal case involving Austin Olokor , 2 others ,Oluwa Esimije and Sunday Amamapoki in the alleged murder of Okhuoimose Omorodion and Genesis Orji who were killed during an internal rancour in ologbo community in Ikpoba okha Local government.
The matter which was slated for continuation of trail today could not hold due to the absent of the 3rd accused person, Sunday Amamapoki .
The state Counsel, Barrister Osasu Ewemande informed the Court of the absent of the 3rd accused person, Sunday Amamapoki .
According to her, the accused person is being remanded in Benin Prison and could not know why the accussed person was not produced in Court.
The other 2 accused persons, Austin Olokor who is on bail and,Oluwa Esimije who is on remand in Oko Prison we’re present in Court.
The 3 accused persons were charged with 5 count charges of alleged conspiracy, kidnapping and murder of Okuomose Omorodion and Genesis Orji in Ologbo dukedom Ikpoba Okha Local government Area of Edo state
The Defendants’ offence contravened Sections 516, 327 and 316 (1) punishable under Section 319 (1) of the Criminal Code Act , Cap C38, Laws of Federation of Nigeria 2004 and Section 2 (2) punishable under Section 3 of the Kidnapping Prohibition (Amendment) Law, 2013 of Edo State.
Speaking with journalists, the counsel to the Ologbo dukedom , Barrister Mathew Edaghese , said, the Prison authority could not produce the 3rd accused person. ”
“As you know trail could not continue without the full compliment of all who are charge, the defendants who are involved.
The Court was forced to adjourn for continuation of hearing for a more convenient date when all the defendants will be available in court.”
His Lordship, Honourable Justice Ifijie adjourned the case to the 29th of November , 2021 for continuation of hearing.
