Sen. Natasha‘s Recall: Court To Rule On Application For Joinder By 2 Applicants.
A Federal High Court sitting in Lokoja, Kogi State capital, has set September 29, 2025 to rule on an application by Salihu Habib and Charity Omole to join in the suit seeking in the recall process initiated by constituents of Kogi Central Senatorial District against Senator Natasha Akpoti-Uduaghan.
The Court at it resumed sitting today, following arguments by Counsels, adjoined till September for ruling on whether the two new applicants can be joined in the suit.
Recalled that the Independent National Electoral Commission had earlier jettison the petition by some constituents owing to it failure to meet the requirements in terms of numbers of constituents that signed the petition.
At the resumption of hearing, Counsel to the applicants seeking to Join, Mike Enahoroh, urged the court to grant the application for Habib Salihu and Charity Omole to join four other applicants earlier in the suit, pointing out that they have indicated interest to join in the matter.
Smart Nwachimere, the defendant Counsel In a counter affidavit, disagreed to have the party’s to be joined in the matter, said following INEC’s decision to discontinue with the case wondered the reason for new joiner, when the suit ought to have been withdrawn.
In a counter affidavit with a written address and adopted as his oral argument,
described the plaintiffs as meddlesome interlopers and busy bodies, pointing out that in Paragraph 3 page 14 of the affidavit said they didn’t give any interest and no identical interest in the originating summon as to why they want to be joined.
He urged that the plaintiffs application for joinder should be disallowed and dismissed.
In his submission, E. A. Osayemi, Counsel for INEC filed a 7 paragraph counter affidavit and a counter written address, said his application has 2 legs, said while the plaintiffs can be allowed to join on their merit, but not for other voters of Kogi Central.
In the affidavit opposing their being joined on one leg, he said they do not have common interest to unlawfully imposed themselves as representatives of all voters in Kogi Central to the suit.
He said no place showed that they have been mandated to represent the people of Kogi Central.
The court presided by Justice Isah Danshan adjoined to rule on the application for joinder.
Recalled that Anebe Jacob Ogirima for himself and four others who are registered voters and constituents of Kogi Central Senatorial District of Kogi State has filed a suit seeking to recall Sen. Natasha, before INEC withdrawal.
