The Chairman of the Nigeria Bar Association NBA, Minna brach has appealed to the members of Niger State House of Assembly to as matter of the law to reconsider the decision taken by the House for the removal from office of Chairman of the Niger State Independent electoral Commission NSIEC.
Answering questions from Journalists in his on the position of the Law on the decision of members of the state House of Assembly to removed from office of the Chairman of Commission,the Chairman of NBA,Barr.Mohammed Waziri Abdulkadir said that the removal of the Chairman is unconstitutional.
According to the Chairman NBA Barr.Mohammed Waziri Abdulkadir stated that the legislatures did not follow due process,hence need for them to retract their earlier decision of removing the Chairman of state Independent electoral Commission of the state from office.
He stressed that section 201(1) of the 1999 Constitution as amended, have it that,”Any person holding any of the office to which this applies shall only be removed from that office by the Governor of that state acting on an address supported by two -thirds majority of the House of Assembly of the state praying that he be so removed for inability to discharge the functions of the office (whether arising from infirmity of mind or body or any other cause) or for misconduct”.
He then called on the members of the Niger state House of Assembly to suspend their actions to allow peace to reign and not to over heat the process.
