Kogi PDP Crisis: Again Hon. Mohammed Sanni Gambo Cries For Justice, As Court Stops Enemona For Abuse of Court Process.
The cry for justice according to Hon. Mohammed Sanni Gambo, runner up in the 31st August, 2024 People’s Democratic Party, Kogi State Congress May have been confirmed by
a Kogi State High Court, sitting in Obangede that dismissed the suit brought before it by Mr. Enemona Anyebe.
The motion to stay proceedings, citing abuse of court process was affirmed by the Court yesterday.
The court noted identical motions filed in Abuja (Dec 9) and Obangede (Dec 18) between same parties on same issue.
The counsel to Capt. Joe Agada had urge the court to hold that the motion was vexatious, irritating, and an affront to the Supreme Court decision, pointing out that such action constitutes abuse of Court processes and the latter action must be dismissed.
The presiding judge, Justice Yahaya Adamu agreed with the position of the Supreme Court and subsequently dismissed their motion.
By this decision, Mr. Anyebe and his Co travellers’ impunity and Contempt of Court according to Capt Agada has come to an end as any further act of impersonation or disregard for court orders is a straight recipe for imprisonment.
Recalled that the Court had earlier ordered a fresh election within 45 days to the office of State Chairman on the 18th of February 2024, this Order elapsed 25th April 2025, with neither PDP nor Mr Anyebe Appealing.
The case adjourned to May 19th, calls for commendation as Capt. Joe Agada supporters says he deserves commendation for his tireless persistence in challenging lawlessness
and impunity within the Party.
It is important to State that Muhammed Sani Gambo, the second runner up in the 31st August, 2024 People’s Democratic Party State Congress, has finally appeal the Judgment of the Kogi State High Court that called for another election for the Party within 45 days from the day it delivered it earlier ruling. This is because the Appeal Court has accepted the Transmission of Proceedings of the Lokoja High Court on the same issue of contempt.
Recalled that a Lokoja High Court, presided by Justice Yahaya Adamu had on February 18th, 2025 delivered judgement where he declared as follows: “The 7th respondents, Enemona Anyebe’s participation in the PDP State Congress of 31/08/2024 is illegal, null and void and hence his purported declaration by PDP as elected official is null and void”, ordered for a fresh election.
Recalled also that prior to the State Congress of the Party held on the 31st August, 2024, a Kogi State High Court issued an order on 31st July, 2024, suit no HC/OKP/54/2024 where Enemona Anyebe and respondents 1-7 were bound to obey. The order barred Enemona Anyebe from contesting the PDP State Congress.
Similarly, the order restrained Enemona Anyebe from purchase of PDP Chairmanship nomination form, presenting himself from being screened and to participate in the State Congress.
Aside the Obangede high court judgment secured by Capt. Agada, not satisfied with the earlier Lokoja High Court ruling, Mohammed approached the Appeal Court on the case of contempt, insisting that the cancellation and ordering of another election was unacceptable.
He maintained that declaration would have been made for him to be declared winner and not another election, insisting that he was the only valid contestant in the August 31st election election.
In the Suit at the appeal Court, Mohammed, the appellant is seeking the court to set aside the judgment of the Lokoja High Court.
Recalled that the suit at the high court was between John Ojodale and the People’s Democratic Party (PDP) and Enemona Anyebe as Respondents for which Mohammed has now joined as an interested Party. The record of proceedings from High Court Of Justice was finally transmitted to the Appeal Court Abuja with the date waiting for it to be mentioned.
As it stands, until the Appeal Court decides on the matter, the judgement has been arrested thus making the party not to conduct election. In any case, there is the issue of Locus, whether one of the contestant participated in the election.
In another development, the Federal High Court sitting in Lokoja will however on the 8th May, 2024 mention the case brought by Mohammed Sanni Gambo, challenging the outcome of the PDP State Congress.
The court will equally establish the case of contempt which from all the available ruling at the Lokoja and Obangede High Court seem to have been established, reason why the second runner up, only valid contestant is seeking the court to pronounced him winner. This he said he was supposed to be a beneficiary, but because he was not a joinder. But now that he has joined, expressed optimism that he would emerge victorious.
