Constitution review: Only some sections, not the entire constitution, can be scrapped, Hon. Shaba clarifies


 

House of Representatives Member representing Lokoja/Kogi Federal Constituency in the House of Representatives, Hon. Shaba Ibrahim MHR; has shed more light on the ongoing constitution review.

He argued that only sections of the constitution can be scrapped but that scrapping of the entire constitution itself is impossible by any arm of the Government.

The lawmaker who is a barrister by training, made the clarification about the constitution of the country, when he featured in a TV programme on AIT on Friday.

“The constitution can’t be scrap because nobody has the power to do so! Not the National Assembly, not the Executive, even the judiciary won’t do that,” the lawmaker argued.
The Kogi lawmaker agreed with those calling for scrapping of some certain sections of the constitution, but “not throwing the baby away with the ‘bath water’”.

He counselled that Nigerians in general should consider using the opportunity of the ongoing constitution review to bring to the table, ideas as to what and what is needed to be amended in the constitution, as that is the essence of the ongoing constitution review.

“Even if everything the people want are inserted in the constitution, if those in charge of its implementation don’t work within its (constitution) provision, the situation won’t still change,” the lawmaker added.

Hon. Shaba blamed those who are to implement the constitution as the reason for the shortcoming of the constitution of the country.

He said that though the constitution is not perfect, the real problem is not the constitution, but those in charge of discharging its provisions.
