Again Federal High Court sacks 20 members of the Cross River State Assembly.

One topic that has remained in the Nigerian political terrain recently is the issue of Defection and the consequences. First, it the Governor of Ebonyi State, David Umahi, who was sacked by a Federal High Court for defecting from People’s Democratic Party yo the ruling APC.

Just this afternoon, a Federal High Court sitting in Abuja, delivered a similar judgement. The court declared that 20 members of the Cross River State House of Assembly are sacked because they defected from the Peoples Democratic Party, PDP, to the All Progressive Congress, APC. This is similar to the court judgement in the case of Ebonyi State.

This particular judgment from the Federal High Court, Abuja, was delivered by Justice Taiwo Taiwo. The Justice declared that “the lawmakers, having abandoned the political party that sponsored them to power, ought to vacate their seats” Vanguard Newspaper reports.

The issue of defection and whether someone who defects from one party to another party should be sacked on the basis of defection has been highly debated. Some have argued that it is not constitutionally right to sack anyone because he defected. Others argue that you can transfer the votes of one party to another.

This concern raises one important question:

Votes casted during election, who owns the votes? Political parties or candidates of political parties?
