The Head of Service (Hos) of the federation Dr Folashade Yemi- Esan has ordered all civil servants to stay clear of partisan politics.
She noted that the provision of the public service Rules (PSR) do not permit Civil servants to participate in partisan politics.
She made the declaration through a circular Hcsf/479/11/19dated 5/5/2022.
The elucidation is sequel to request by her office on the provision of PSR Vi’s a vis the supreme Court judgement as it relates to participation of civil servants in partisan politics.
The Hos in her emphasis referred civil servants to the legal opinion of the Minister of Justice Abubakar Malami on the issue wherein he referred to the letter ref no SGF/PS/HCSF/210/11/ dated 26/11/2018 among other things the Minister noted that ” neither the 1999 constitution nor the supreme court has authorized civil servants to engage in partisan politics.
The provision of rules 030422 and 030423 of the civil service Rules (2008 edition) were not nullified by the supreme court , hence they remain in force and binding on all civil servants seeking to participate in nomination exercise or party primaries.”
She also stressed that Malami asserted that the provisions of rules 030402(g) , 030422 and 030423 of the PSR (2008 edition) should be enforced . Noting that the attention of the civil servants should be drawn to the fact that the supreme court judgment in INEC vs Musa did not nullify these provisions of the PSR hence any Civil servant must comply with the provision of PSR if he or she wishes to seek nomination or participation in partisan party primary elections.
