The Supreme Court Sitting in Abuja, would on Monday decide on the winner of the last November Kogi Governoship Election.
Recall that the Peoples Democratic Party candidate Engr Musa Wada had challenged the outcome of the election with the claim that the 2nd and 3rd Respondents did not win the Kogi State Election by a majority of the lawful votes cast.
The matter was decided in favour of the APC and Gov. Yahaya Bello in a split decision of two to one Justices at the Tribunal, a decision that made the PDP head to the Appeal Court.
At the Court of Appeal sitting in Abuja, the court had earlier dismissed the petition, said declaration of elections by INEC are presumed correct unless proven otherwise.
The court said the PDP only pursued its petition on one ground, says the burden to rebut the presumption arising from INEC’s declaration that Yahaya Bello and the APC won the last Kogi State Gubernatorial Elections could not be established.
The court said the appellants also needed to prove that the declared winners did not score the majority of the lawful votes cast.
According to Appeal Court Justices, the results of any polling unit where overvoting is alleged and proven will be cancelled but new elections can only be ordered if it is further proved that the results of that polling unit, if removed from the overall results, will change the outcome of the election.
The court said the appellants did not link their documents to their claims, merely dumped it on the Tribunal, said the Tribunal was right to treat them as having no evidentiary value, as they could not prove acts of alterations or how the alleged alterations affected the overall results of the election.
On the issues of Multiple thumb-printing that was pleaded under corrupt practices. The Appeal Court held that the allegation was subsequently abandoned to all intents and purposes. Evidence in that regard goes to no issue, including that of PW19 – the expert witness.
Expert evidence is only required where the expert can furnish the court with scientific and other technical evidence which must be outside the knowledge of the judge. It is apparent that expert evidence may be admissible but not indispensable.
PW19 claimed to be acting on the order of the court but under cross-examination it became clear that he had been acting with the appellant long before the order of the Tribunal for him to get involved. PW19 exceeded his mandate to determine fingerprints when he went over and beyond to engage in counting of ballots. He also admitted that he is not a fingerprint expert. Also none of the other so-called experts who allegedly examined the documents with him signed the report and no reason was given for this. The trial Tribunal was right in rejecting his report.
The Court of Appeal therefore dismissed PDP’s petition with costs of N100,000.

His wealth of knowledge is incomparable, he is very meek in nature and readiness to help solve the problems of his subjects, his community and the entire state according to the available ability and resources.

Obaseki Launches Sex Offenders’ Register, Urges Prosecutors To Prioritise Sexual Cases

Edo State Governor, Mr. Godwin Obaseki, on Wednesday, launched the state’s Sex offenders’ Register, with a charge to prosecutors to prioritise all cases of Sexual and Gender-Based Violence (SGBV) in the state.
The governor also inaugurated the state’s Sexual Assault Referral Center (SARC) in Benin City, named after Vivian Ogu, a 14-year-old girl who was killed by armed robbers because she resisted attempts by the robbers to rape her.
Speaking to journalists after signing the Edo Sexual Offenders’ Register, Obaseki said the register will address the incidence of sexual violence in the state by naming and shaming rapists and those who commit other forms of gender-based crimes.
According to him, “It is a privilege to formally sign the Sexual Offenders’ Register; for us as a government, we believe that except you have punishments for crimes you cannot reduce certain crimes in our society.
“With technology today, we should be able to undertake a lot of investigations and accelerate paths to investigations so that we can prosecute and get convictions for these offences.
“Unfortunately, it is humans that will still mar these technologies, but I just want to appeal to our prosecutors and judges to prioritise cases that relate to sexual offences.”
“If you do an analysis of the cases we have, 70 per cent are under investigation. We will work towards having more convictions so that it will send a very strong message and signal that we will not tolerate sexual offences in Edo, particularly rape,” the governor said.
Meanwhile, the Commissioner for Justice and Attorney General of the state, Prof. Yinka Omorogbe, noted that the issue of sexual and gender-based violence is a plague to Nigeria and the international community leading to trauma and deaths.
The SARC is a response to the fate suffered by Vivian Ogu, Uwaila Omozuwa and many other victims of sexual violence.
The commissioner said: “The Vivian Ogu Center is a one-stop free clinic for survivors of sexual and gender-based violence and is a safe environment where survivors are given all the required care and support, they need.
“The services rendered at the center include medical examination of survivors, screening and preventive treatment for Human Immunodeficiency Virus (HIV) and other sexually transmitted infections, collection of forensic evidence, screening for drugs where the use of stupefying substances is suspected.
“The sex offenders’ register is a repository of offences containing names and information about all persons who have been convicted or charged with rape and other sexual offences.
“It will also contain information about organisations and persons that provide assistance to victims as defined by the Edo Violence Against Person’s Prohibition (VAPP) Law 2018.”
